Family Court of Western Australia - court fees

Eligible concession card holders and other people who would have difficulty in paying the standard fee may apply for a reduction or an exemption of court fees. Assessments can take into account income, day-to-day living expenses, assets and liabilities and the financial hardship that paying full fees may cause.

How to Apply

For all fees other than Divorce or Nullity, clients need to complete an 'Application for Exemption from Payment of Court Fees - General' or in case of financial hardship, an 'Application for Exemption from Payment of Court Fees - Financial Hardship'.

For Divorce and Nullity Applications, clients need to complete an 'Application for Reduction of Court Fees - General' or in case of financial hardship, an 'Application for Reduction of Court Fees - Financial Hardship'.

These forms are available on the Family Court website. Forms need to be submitted to the Family Court Registry located at 150 Terrace Rd (cnr Victoria Ave), Perth, in person or by mail.​

Eligibility

Holders of a Pensioner Concession Card, Health Care Card, Commonwealth Seniors Health Card, Department of Veterans’ Affairs cards, those receiving legal aid, Youth Allowance, Austudy or Abstudy payments, or who have received a 'Notice of Exemption' from an approved Community Legal Centre, those under 18 years of age, an inmate of a prison or someone who has otherwise been legally detained in a public institution, and those who would experience financial hardship if required to pay the full fee.
